TERMS & CONDITIONS SCHEDULE

1. These terms and the Promotion Outline together form the “Conditions of Entry” for this Promotion. Capitalised terms have the meaning given in the Promotion Outline unless otherwise stated. If there is any inconsistency between these terms and the Promotion Outline, the Promotion Outline prevails. By submitting an Entry, you agree to these Conditions of Entry.

2. The Promoter is Chery Motor Australia Pty Ltd ACN 662 958 205 trading as OMODA JAECOO Australia (“Promoter”, “we”, “us”). Any updates to these Conditions of Entry will be made available on the Website.

3. Entry is open to Australian residents aged 18 years or over at the time of entry. Each Nominee must be: (a) a grandparent (including a step-grandparent) of the entrant; (b) an Australian resident; and (c) aware of, and consenting to, the Entry before it is submitted. This includes consenting to the disclosure of their personal information to the Promoter and to being contacted by the Promoter.

   The directors, management, employees, officers, agents and contractors of the Promoter, of any authorised OMODA JAECOO dealer, and of any agency, production company, supplier or company associated with this Promotion, and the immediate families of those people (spouse, partner, parent, grandparent, child (natural or adopted) and sibling) are ineligible to enter or be nominated. 

4. To enter, you must complete the Entry Procedure during the Period. Entry is free. You are responsible for any costs you incur in accessing the Website (for example, internet or mobile data charges).

5. (a) Only one (1) Entry per entrant is permitted; (b) A Nominee may be the subject of only one (1) winning Entry; (c) We will not accept Entries that are incomplete, illegible, or generated or submitted by computers or other automated means; (d) We may verify the validity of any Entry, including by contacting the entrant or Nominee to confirm eligibility and consent before winners are confirmed; and (e) We may disqualify any Entry that, in our reasonable opinion, does not comply with these Conditions of Entry, or that tampers or interferes with the entry mechanism.

6. This is a game of skill. After the Period closes, a panel of judges appointed by the Promoter will review all valid Entries. The panel will select the three (3) winning Entries as those that, in the judges’ opinion, best demonstrate the following criteria:

   Storytelling and creativity (30%): How compellingly and originally the Entry tells the Nominee’s story.

   Heart and connection (30%): How well the Entry conveys the Nominee’s character and why the adventure is meaningful to them.

   Achievability (25%): The extent to which the adventure can reasonably be delivered safely within Australia, within the prize value and within the Filming Window.

   Suitability for filming (15%): The adventure’s potential to be captured as an engaging standalone episode.

   The judges assess the merit of each Entry as submitted. The judges’ decision is final and no correspondence will be entered into. The judges will also select and rank three (3) reserve Entries. A reserve Entry is used if a winning entrant or Nominee is ineligible, cannot be contacted, cannot participate, or does not comply with the Prize Claim requirements by the Prize Claim Date.

   As this is a game of skill in which chance plays no part in determining the winners, no trade promotion lottery permit is required in any Australian state or territory.

7. This Promotion may be promoted on social media platforms. It is in no way sponsored, endorsed, administered by, or associated with Instagram, Facebook, Meta Platforms, Inc., TikTok or any other platform operator. Any questions, comments or complaints must be directed to the Promoter.

8. You are responsible for the content of your Entry. It must be your original work and true and accurate in all material respects. Your Entry must not contain any content that: (a) includes the personal information, image or likeness of any person (other than the Nominee) without their consent; (b) is unlawful, misleading, deceptive, defamatory, obscene, threatening, offensive, discriminatory, indecent or otherwise objectionable, or that violates any person’s privacy or publicity rights; or (c) infringes the intellectual property rights of any person.

   The Promoter may, in its absolute discretion, reject, remove or refuse to consider any Entry that it considers inappropriate, inconsistent with the Promoter’s brand values, or non-compliant with these Conditions of Entry.

9. By submitting an Entry, you grant the Promoter a non-exclusive, royalty-free, irrevocable, worldwide licence to use, reproduce, adapt, publish and communicate your Entry (including the Nominee’s story) for purposes connected with this Promotion and the Promoter’s marketing, in any media, without further compensation. You consent to any act or omission that would otherwise infringe your moral rights in the Entry, and further warrant that you are entitled to grant this licence and that each Nominee has consented to their story being shared.

10. The Promoter is bound by the Australian Privacy Principles in the Privacy Act 1988 (Cth).
    (a) The Promoter collects personal information about entrants, Nominees and companions to conduct this Promotion, deliver the Prizes and produce the Content (see clause 13).
    (b) The Promoter may disclose that information for those purposes and related purposes to its agents, production company, travel and activity providers and other service providers.
    (c) Winners, Nominees and companions may be asked for health, mobility, dietary and accessibility information so that the adventure can be planned safely. That information is collected with their consent and used only for that purpose.
    (d) Entry is conditional on providing the information requested.
    (e) Subject to your consent where required, the Promoter may use your information for marketing and promotional purposes. You may opt out at any time.
    (f) Personal information is handled in accordance with the Promoter’s Privacy Policy at https://www.omodajaecoo.com.au/privacy-policy. Requests to access or correct information, or to opt out, should be directed to the Promoter.

11. Each Prize is a bucket list adventure inspired by the winning Entry. It is designed by the Promoter in consultation with the winner and Nominee(s). The adventure must take place within Australia.
    The Prize includes such of the following as the Promoter determines are required: (a) return economy travel from the Australian capital city airport nearest each participant’s residence (or ground transport); and (b) up to 1 nights’ accommodation; the cost of the experience(s) forming the adventure. 

    The Prize is for the Nominee(s) and up to two (2) companions, one of whom must be the winning entrant. Companions must be aged 18 years or over unless the Promoter agrees otherwise.
    The Prize must be taken on dates determined by the Promoter between 16^th November 2026 and 30^th November 2026 (the “Filming Window”), aligned with the production schedule. The Prize does not include: (d) travel insurance; (e) spending money; (f) meals, transfers or activities not specified by the Promoter; (g) personal expenses; or (h) any other cost not expressly stated.

    The participants acknowledge the following: (i) activities are subject to the terms, conditions and safety requirements of third-party providers, including age, health, weight and fitness restrictions. Participants may be required to sign the provider’s own waiver; (j) the Promoter is not obliged to deliver the adventure exactly as described in the Entry. The Promoter may modify, substitute or remove any element of the adventure for reasons of safety, feasibility, availability, weather, cost or the health of any participant. The total value of the Prize will not exceed the prize value stated in the Promotion Outline and; (k) if a Nominee is unable to participate during the Filming Window, including for health reasons, the Promoter may, at its discretion, reschedule the adventure, offer an alternative adventure of no greater value, or award the Prize to a reserve Entry.

    The Prize is not transferable, exchangeable or redeemable for cash. If any part becomes unavailable for reasons beyond our control, we may substitute an element of equal or greater value, subject to any applicable legal requirements. Prize values are accurate as at the start of the Period. Participants are responsible for any tax liability associated with the Prize. Participants are strongly encouraged to obtain their own travel insurance.

12. Winners will be notified as set out in the Promotion Outline. If, having made reasonable efforts, we cannot contact a winner, or the Prize Claim requirements are not met by the Prize Claim Date, the Entry may be deemed invalid and we may award the Prize to the next ranked reserve Entry. Each Prize is conditional on the winner, each Nominee and each companion signing, before filming commences: (a) the Promoter’s Filming and Marketing Consent; and (b) the Participant Risk Acknowledgement, Release and Waiver (together, the “Release Documents”). A parent or guardian must sign for any participant under 18 if the Promoter permits their entry.
    
     

    Each Nominee must sign the Release Documents personally. Alternatively, a person holding a valid power of attorney for the Nominee may sign, if the Promoter agrees. If the Release Documents are not signed within the time we specify, the Prize may be forfeited and awarded to the next ranked reserve Entry.

13. Participation in filming is a condition of the Prize. Each winner’s adventure will be filmed and photographed as a standalone episode (the “Content”). The Content will be published on the Promoter’s social channels and used for broader marketing purposes, as set out in the Filming and Marketing Consent. Participants agree to take part in reasonable promotional activity in connection with the Prize. The first names, suburbs and states of winners and Nominees may be published. Participants have no right of approval over the Content. The Promoter is not obliged to publish any Content.

14. Participants must be in suitable health to undertake the adventure and must follow all reasonable directions of the Promoter, its production crew and activity providers. The Promoter may end any person’s participation, without compensation, if that person behaves in an unsafe, unlawful or inappropriate manner.

15. To the extent permitted by law, the Promoter will not be liable for any loss or damage, including direct or consequential loss, or personal injury suffered or sustained in connection with this Promotion or any Prize (including any travel or activity forming part of a Prize). In particular, the Promoter is not responsible for any loss that: (a) was not reasonably foreseeable; (b) was not caused by the Promoter’s breach of these Conditions of Entry or its negligence; (c) is a business loss (such as lost data, lost profits or business interruption) or a loss suffered by a non-consumer; (d) was caused by factors reasonably outside the Promoter’s control (such as the acts or omissions of third-party travel or activity providers, weather, or faults in third-party equipment); or (e) was caused or contributed to by a participant’s breach of these Conditions of Entry or a participant’s negligence.

    Nothing in these Conditions of Entry limits any rights you have under the Australian Consumer Law that cannot be excluded. You acknowledge that travel and adventure activities involve inherent risks, which are addressed further in the Release Documents.

16. The Promoter accepts no responsibility for any problem or technical malfunction of any communication network. The Promoter also accepts no responsibility for any late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected Entries, claims or correspondence, whether due to error, omission, tampering, deletion, theft, transmission interruption, communications failure or otherwise. If this Promotion cannot run as planned for reasons beyond the Promoter’s reasonable control, the Promoter reserves the right, subject to any applicable law, to: (a) cancel, suspend, modify or terminate the Promotion; and (b) select the winners from eligible Entries received up to that time. Such reasons include infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud or technical failure. All decisions the Promoter makes regarding any aspect of the Promotion are final.

17. These Conditions of Entry are governed by the laws of New South Wales.
