| Entry Procedure | Using LEGO® type bricks, build an original creation depicting the dream family adventure you would take in the all-new JAECOO J5, then complete both of the following during the Period: (a) post one (1) final image of your completed build to Instagram or Facebook, tagging @omodajaecooau (Instagram) or Omoda Jaecoo Australia (Facebook) and using #ourjaecooadventure, with your account set to public so the post is visible; and (b) complete the submission form on the competition landing page at omodajaecoo.com.au, including the final image, your social media handle, and a written description of the inspiration for your build (50 words or fewer). An entry is only valid if both steps (a) and (b) are completed. Entrants may also submit one (1) video (up to 1 minute) showing the creation process. The video is optional and, if submitted, may be taken into account by the judges and used by the Promoter under clause 14. |
| Build Requirements | The build must: (a) be constructed from LEGO® type building bricks; (b) measure no less than 20cm (L) x 20cm (W) x 30cm (H) and no more than 40cm (L) x 40cm (W) x 60cm (H); and (c) be securely constructed and capable of safe transport, as selected entries may be required for display and promotional use. |

TERMS & CONDITIONS SCHEDULE
General
These terms and the Promotion Outline together form the "Conditions of Entry". Capitalised terms have the meaning given in the Promotion Outline unless otherwise stated. If there is any inconsistency, the Promotion Outline prevails. By submitting an Entry (or, for an entrant under 18, by a parent or legal guardian submitting an Entry on their behalf), you agree to these Conditions of Entry.
The Promoter is Chery Motor Australia Pty Ltd ACN 662 958 205 trading as OMODA JAECOO Australia. Any updates to these Conditions of Entry will be made available on the Promoter's website.
Entry is open to Australian residents, subject to clause 4. The directors, management, employees, officers, agents and contractors of the Promoter, of any authorised OMODA JAECOO dealer, of the judges, and of any agency, supplier or company associated with this Promotion, and their immediate families (spouse, partner, parent, grandparent, and sibling), are ineligible to enter.
Entrants under 18 years of age ("Minor Entrants") may participate only if a parent or legal guardian:
- Completes and submits the entry form on the Minor Entrant's behalf and provides their own contact details as the point of contact for the Entry.
- Accepts these Conditions of Entry on their own behalf and on behalf of the Minor Entrant, including the licence and consents in clauses 14 to 17.
- Consents to the collection, use and disclosure of the Minor Entrant's personal information in accordance with clause 19.
Any prize won by a Minor Entrant will be awarded to their parent or legal guardian to hold on the Minor Entrant's behalf. The Promoter may require evidence of the parent/guardian relationship and reserves the right to declare invalid any Entry by a person under 18 submitted without parental or guardian involvement.
Entry is free, although entrants must supply their own building bricks and materials at their own cost. No purchase of any Promoter product is required.
To enter, you must complete the Entry Procedure and satisfy the Build Requirements set out in the Promotion Outline during the Period. Incomplete, corrupted, late or non-conforming Entries may be declared invalid at the Promoter's reasonable discretion.
All Entry content (images, video and description) (together, "Entry Content") must be the entrant's original work and must not:
- Infringe the intellectual property or other rights of any person.
- Include any third-party brand, logo or trademark other than as reasonably incidental to the build.
- Identify or depict any person who has not consented to their inclusion (and, for any person under 18 depicted, without the consent of that person's parent or legal guardian).
- Contain anything unlawful, misleading or deceptive, defamatory, obscene, or otherwise inconsistent with the Promoter's brand values.
The Promoter may in its reasonable discretion refuse or remove any Entry that does not comply with this clause.
This is a game of skill and chance plays no part in determining the winners. Entries will be assessed by a panel of representatives of the Promoter on:
- Creativity and originality (a unique and imaginative interpretation of the entrant's dream family adventure).
- Craftsmanship and attention to detail.
- Brand connection (how well the creation captures the JAECOO spirit of adventure and design).
- Storytelling and presentation.
- Overall visual impact.
The three highest-scoring entries will be awarded first, second and third prize respectively.
This Promotion is in no way sponsored, endorsed or administered by, or associated with, Instagram, Facebook or Meta Platforms, Inc. ("Meta"). Each entrant releases Meta from all liability in connection with this Promotion and acknowledges that any information provided is provided to the Promoter and not to Meta. Entrants must comply with the applicable platform terms of use. The Promoter is not responsible for any act or omission of Meta, including the removal, non-display or unavailability of any post.
In the event of a tie, the tied entries will be re-assessed by the judging panel against the criteria in clause 8 and the panel's further determination will be final. All judging decisions are final, made on individual merit, and no correspondence will be entered into.
Prizes are as set out in the Promotion Outline. VISA gift cards are subject to the issuer's terms and conditions, including any activation requirements and expiry dates. Prizes are not transferable or exchangeable and cannot be taken as cash. If a prize, or element of a prize, becomes unavailable for reasons beyond the Promoter's reasonable control, the Promoter may substitute a prize of equal or greater value, subject to any applicable regulatory requirements. The display and social feature elements of the first prize are subject to the relevant event proceeding and third-party venue/organiser requirements, and have no cash value.
Before a prize is awarded, the Promoter may require the winner, or their parent/guardian, to verify their identity, age, residency and compliance with these Conditions of Entry, including by signing a winner's declaration confirming the Entry Content is their original work and that all required consents have been obtained. If a winner cannot be contacted, fails verification, or does not claim their prize within fourteen (14) days of notification, the prize may be forfeited and awarded to the next highest-scoring eligible Entry.
Entrants must retain their physical build in substantially its submitted form until [17th of September]. Shortlisted and winning entrants may be required to make their build available for promotional display, including the first-prize display event. Where a build is required for display, the Promoter will arrange and pay for freight or courier transport and will take reasonable care of the build while in its custody, but (to the maximum extent permitted by law and subject to clause 22) does not accept liability for damage to or loss of builds in transit or on display. Builds remain the property of the entrant and will be returned within a reasonable time following display.
By submitting an Entry, each entrant, or, for a Minor Entrant, their parent or legal guardian on the entrant's behalf, grants the Promoter a non-exclusive, perpetual, irrevocable, worldwide, royalty-free licence to use, reproduce, modify, adapt, publish, communicate and display the Entry Content, in whole or in part, for promotional, marketing and publicity purposes in any media, including across the Promoter's websites, social media channels, digital platforms, advertising and at events. This licence includes the right to sublicense to the Promoter's related bodies corporate, dealers, and marketing and creative agencies for the same purposes.
Entrants retain ownership of the copyright in their Entry Content. Entrants consent, and, for Minor Entrants, the parent/guardian consents on their behalf to the fullest extent permitted by law, to the Promoter's use of the Entry Content without attribution and to acts or omissions that may otherwise infringe their moral rights under the Copyright Act 1968 (Cth), for the purposes described in clause 14.
- Each entrant warrants that:
- The Entry Content is their original work.
- The Promoter's use of the Entry Content in accordance with clause 14 will not infringe the rights of any third party.
All persons appearing in the Entry Content have given, or, for persons under 18, their parent or legal guardian has given, informed consent to its submission and to the uses described in clause 14.
Winners agree, and parents/guardians of Minor Entrant winners agree on their behalf, to participate in reasonable publicity connected with the Promotion, including the announcement of winners by first name, initial and state/territory, at no additional compensation. Publicity involving a Minor Entrant will only occur with the prior consent of their parent or legal guardian.
This Promotion is conducted solely by the Promoter. Nine Network, the LEGO Group and the producers and rights holders of the LEGO Masters program are not associated with, do not sponsor or endorse, and are not responsible for, this Promotion in any way. LEGO® is a trademark of the LEGO Group. Any queries, comments or complaints regarding the Promotion must be directed to the Promoter, not to Nine Network or the LEGO Group.
The Promoter collects entrants' personal information, and, where applicable, the personal information of Minor Entrants and their parents/guardians, to conduct the Promotion, including to administer entries and voting, verify eligibility, award prizes, carry out the promotional uses described in these Conditions of Entry, and may disclose it to third parties. Subject to your consent where required, the Promoter may use your information for marketing and promotional purposes. You may opt out at any time. Personal information will be handled in accordance with the Promoter's Privacy Policy at https://www.omodajaecoo.com.au/privacy-policy. Requests to access, correct or opt out should be directed to the Promoter.
The Promoter may, subject to any applicable law and regulatory requirements, modify, suspend or cancel the Promotion if it cannot proceed as planned for reasons beyond the Promoter's reasonable control, including technical failures, unauthorised intervention, fraud, or any event constituting force majeure. The Promoter is not responsible for technical malfunctions of any network, system or platform, or for lost, late, corrupted or misdirected Entries or votes, except to the extent caused by the Promoter.
Any reference to LEGO Masters
,in connection with this Promotion is made with permission and does not imply any sponsorship, endorsement, association or approval by those parties beyond that expressly agreed. All intellectual property in the Promoter's names, logos and brand assets remains the property of the Promoter or its licensors, and nothing in these Conditions of Entry grants any entrant a right to use those trademarks or brand assets except as necessary to participate in the Promotion.- Nothing in these Conditions of Entry excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law or any other applicable law that cannot lawfully be excluded. Subject to that, the Promoter excludes liability for any loss or damage, including indirect or consequential loss, loss of opportunity, or loss of enjoyment, suffered in connection with the Promotion or any prize, including:
- Any technical difficulties or equipment malfunction.
- Any theft, unauthorised access or third-party interference.
- Any Entry, vote or prize claim that is late, lost, altered, damaged or misdirected.
- Any variation in prize value.
Use of a prize, except in each case to the extent the loss or damage is caused by the Promoter's negligence or wilful misconduct, and except that nothing in this clause limits the Promoter's liability for personal injury or death.
If any provision of these Conditions of Entry is invalid or unenforceable, it will be severed and the remaining provisions will continue in force.
- These Conditions of Entry are governed by the laws of New South Wales, and each entrant submits to the non-exclusive jurisdiction of the courts of that state.
