TERMS & CONDITIONS SCHEDULE

  1. These terms and the Promotion Outline together form the "Conditions of Entry" for this Promotion. Capitalised terms have the meaning given in the Promotion Outline unless otherwise stated. If there is any inconsistency between these terms and the Promotion Outline, the Promotion Outline prevails. By registering and/or participating, you agree to these Conditions of Entry.

  1. The Promoter is Chery Motor Australia Pty Ltd (ACN 662 958 205) trading as Jaecoo Motor Australia ("Promoter", "we", "us"). Any updates to these Conditions of Entry will be made available at the activation and/or on the Promoter's website.

  1. Participation is open to persons who attend the activation in person during the advertised hours. Entrants under 18 years of age must be registered by a parent or guardian and remain under that person's supervision at all times while participating. The directors, management, employees, officers, agents and contractors of the Promoter, of any authorised Jaecoo Motor Australia dealer, and of any agency, supplier or company associated with this Promotion (including activation and event staff), and their immediate families, are ineligible to participate.

  1. To participate, during the activation you must: (a) register your details by scanning the QR code and completing the entry form; (b) present your submission confirmation to activation staff; and (c) take your shot(s). Each person may take up to three (3) shots. Registration and participation are free. You are responsible for any costs you incur in accessing the QR code or entry form (for example, mobile data charges).

  1. A "goal" is scored when the ball comes to rest inside the Jaecoo Motor Australia boot, as adjudicated by activation staff. Whether a goal has been scored is determined by activation staff in their sole discretion, and their decision is final. No correspondence will be entered into. You must take your shots from the marked position and in accordance with the directions of activation staff.

  1. Subject to availability and clause 7, each goal scored entitles the participant to one (1) prize. The specific prize awarded for each goal is determined by a random draw from the prizes then available at the activation. Prizes are awarded on a "while stocks last" basis: once the prize pool is exhausted, no further prizes will be awarded, even for a successful goal. A participant may win a maximum of three (3) prizes (one per goal). Prizes are not transferable, exchangeable or redeemable for cash. If a particular item is unavailable, the Promoter may substitute an item of equal or greater value, subject to any applicable legal requirements. The winner is responsible for any tax liability associated with a prize.

  1. This Promotion combines an element of skill (landing the ball in the boot) with an element of chance (the prize is allocated by random draw). Consistent with the conservative regulatory approach, the chance element causes the Promotion to be treated as a trade promotion lottery. This Promotion is conducted solely in New South Wales. Under the Community Gaming Act 2018 (NSW) and the Community Gaming Regulation 2020 (NSW), a trade promotion gaming authority is required only where the total prize value of the Promotion exceeds $10,000. Where an authority is required and granted, its number will be displayed at the activation.

  1. One registration per person. We may refuse to allow participation, or disqualify any participant, who (in our reasonable opinion) has not validly registered, does not comply with these Conditions of Entry, or attempts to tamper with or interfere with the entry mechanism or the activation.

  1. Participation involves physical activity. You participate at your own risk and must: (a) follow all directions of activation and venue staff; (b) not participate if affected by alcohol or any substance, or if doing so would be unsafe for you or others; and (c) take reasonable care for your own safety and the safety of others, including any children you supervise. The Promoter and its staff may refuse participation to, or remove, any person who behaves in an unsafe, disruptive, offensive or inappropriate manner, or who does not comply with these Conditions of Entry or venue rules.

  1. The Promoter is bound by the Australian Privacy Principles in the Privacy Act 1988 (Cth). The Promoter collects the personal information provided at registration to conduct this Promotion and may disclose it to third parties (including agents, service providers and the Western Sydney Wanderers) for that purpose and related purposes. Registration is conditional on providing this information. Subject to your consent where required, the Promoter may use your information for marketing and promotional purposes; you may opt out at any time. Personal information is handled in accordance with the Promoter's Privacy Policy at https://www.omodajaecoo.com.au/privacy-policy. Requests to access, correct or opt out should be directed to the Promoter.

  1. By participating, you acknowledge that the activation may be photographed and filmed. If you are featured in any such content, you consent to the Promoter using your image and likeness for promotional purposes in any media for up to twelve (12) months, to the extent permitted by law. If you do not wish to be featured, please advise activation staff.

  1. To the extent permitted by law, the Promoter will not be liable for any loss or damage (including direct or consequential loss) or personal injury suffered or sustained in connection with this Promotion, the activation or any prize. In particular, the Promoter is not responsible for any loss that: (a) was not reasonably foreseeable; (b) was not caused by the Promoter's breach of these Conditions of Entry or its negligence; (c) is a business loss or a loss suffered by a non-consumer; (d) was caused by factors reasonably outside the Promoter's control; or (e) was caused or contributed to by a participant's breach of these Conditions of Entry or a participant's negligence. Nothing in these Conditions of Entry limits any rights you have under the Australian Consumer Law that cannot be excluded. You acknowledge that participation in a physical ball-kicking activity carries inherent risks, which you voluntarily accept for yourself and any person you supervise.

  1. The Promoter accepts no responsibility for any problem or technical malfunction affecting the QR code, entry form or any communication network, or for any late, lost, incomplete, illegible, corrupted or misdirected registrations. If this Promotion cannot run as planned for reasons beyond the Promoter's reasonable control (including technical failure, unsafe conditions, weather, or disruption, cancellation or rescheduling of the event), the Promoter reserves the right, subject to any applicable law, to cancel, suspend, modify or terminate the Promotion. All decisions the Promoter makes regarding any aspect of the Promotion are final.

  1. These Conditions of Entry are governed by the laws of New South Wales.
